Red Flag” Legislation Heads Back to the House for a Concurrence Vote

This past Wednesday, the Colorado Senate passed HB 1177 by an 18 to 17 vote. This legislation could infringe on an individual’s Second Amendment rights without due process. This “red flag” bill would authorize the seizure of an individual’s private property through an ex parte proceeding. A broad class of individuals could make unchallenged statements, before a judge, alleging that someone is a danger to themselves or others. This would be enough for law enforcement to enter that person’s home and confiscate their private property. HB 1177 will head back to the House for a concurrence vote.
